By accessing or using Postscriptum ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. You must be at least 16 years old to use Postscriptum.

2. Description of Service

Postscriptum is a private space for grief, reflection, and memory. The Service allows you to create a digital persona of a loved one and have AI-powered conversations as a way to process grief, preserve memories, and find comfort.

3. Account Terms

• You must provide accurate information when creating your account
• You are responsible for maintaining the security of your account
• You may only have one account per person
• Your account is personal and may not be shared with others
• You must notify us immediately of any unauthorized use of your account

4. Subscription and Payment

Postscriptum offers monthly and annual subscription plans:

• Monthly Plan: Includes a 7-day free trial. Your free trial will automatically convert to a paid monthly subscription at $29/month unless you cancel before the trial ends.
• Annual Plan: Charged immediately upon subscription with no trial period.
• Refunds: You may request a full refund within 7 days of your payment. After 7 days, subscriptions are non-refundable, but you may cancel at any time to prevent future charges.
• Cancellation: You can cancel your subscription at any time from your account settings. You will retain access until the end of your current billing period.

5. Pricing Changes

We may change our subscription prices from time to time. Any price changes will only apply to new subscribers or upon renewal of existing subscriptions. Your current subscription price will remain unchanged until your next renewal date.

6. AI-Generated Content Disclaimer

Important: The conversations in Postscriptum are powered by artificial intelligence (OpenAI). Please understand the following:

• AI responses are generated automatically and may not always be accurate, appropriate, or what you expect
• The AI is not a real person and cannot truly replicate your loved one
• AI responses should not be considered as professional advice (medical, legal, psychological, or otherwise)
• While we strive to ensure appropriate and sensitive responses, AI-generated content may occasionally be inaccurate or unexpected. If you experience any issues, please contact us at support@postscriptum.ink
• If you experience distress from AI responses, please seek support from qualified professionals

Postscriptum is intended as a tool for comfort and memory preservation, not as a replacement for professional grief counseling or mental health support.

7. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the Service
• Use automated scripts, bots, or scrapers to access the Service
• Interfere with or disrupt the Service or its servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to harass, abuse, or harm others
• Resell or commercially exploit the Service without our permission
• Create multiple accounts to abuse trials or promotions

8. Account Termination

If we believe you have violated these Terms, we will first send you a warning and give you an opportunity to correct the violation. If the violation continues or is severe, we reserve the right to suspend or terminate your account. You may delete your account at any time from your account settings.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Postscriptum and are protected by international copyright, trademark, and other intellectual property laws. Your personal data and the content you create (personas, conversations) remain yours.

10. Limitation of Liability

To the maximum extent permitted by law, Postscriptum shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to emotional distress arising from AI-generated content. The Service is provided "as is" without warranties of any kind, either express or implied.

11. Service Availability

We strive to keep Postscriptum available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through a notice on the Service. Your continued use of Postscriptum after such changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law provisions.
